Before rule changes, buyer agents (co-operating brokers respresent buyers) were typically compensated by the listing broker by sharing the commission being paid by the seller. Although commissions are and were negotiable, that commission rate was more often than not 5% to 7% of the sales price. The new rule says the buyer's agent must be compenstated directly by the seller.
Our listing rate of 1.5% is a commission paid directly to us. The buyer has a couple of choices:
1. Pay their buyer agent directly (by written agreement).
2. Negotiate with the seller to have their buyer's agent paid by the seller.
3. Buy without the use of a buyer's agent.
Whether or not a seller agrees to pay a buyer's agent normally depends upon:
1. The buyer's offer price.
2. The financial strength of the buyer.
3. The closing date.
4. Other terms that effect the seller's willingness to accept the offer.
The seller is not obiligated to accept an offer that includes the seller paying a commission to a buyer's agent.
